Meet South Dakota Notary Eligibility Requirements

Applicants must be at least 18 years old, a U.S. citizen or legal resident, and a resident of South Dakota. Individuals with felony convictions may not qualify unless their civil rights have been restored.

Complete the South Dakota Notary Public Application

Obtain and complete the notary application from the South Dakota Secretary of State’s website.

Obtain a $5,000 Surety Bond

Purchase a $5,000 surety bond from an insurance or bonding company. The bond must be valid for the six-year commission term.

Submit the Application and Fee

Mail the completed application, surety bond, and the $30 filing fee to the South Dakota Secretary of State’s office.

Receive Your Notary Commission Certificate

Once approved, you will receive your commission certificate. You must purchase a South Dakota-compliant notary seal or stamp.

Purchase a Notary Seal or Stamp

Get a notary seal or stamp that meets South Dakota’s legal requirements, including your name, “Notary Public,” “State of South Dakota,” and commission expiration date.

Keep a Notary Journal (Recommended)

Although not required, maintaining a notary journal is strongly recommended for tracking notarizations and ensuring legal protection.
